Petitioner is languishing in judicial custody since 21.12.2017 in connection with Chausa P.S. Case No. 379 of 2017 for offences punishable under Section 30 (A) of the Bihar Prohibition and Excise Act, 2016.
The prosecution case, as lodged by the police personnel, is that during patrolling duty they got secret information that huge quantity of illicit liquor is kept inside the house of the petitioner, a raid was conducted and from the house of the petitioner 60 liters of Mahua wine was recovered. Accordingly, a seizure list was prepared.
It has been submitted by the learned counsel for the
Patna High Court Cr.Misc. No.14433 of 2018 (2) dt.13-03-2018 2/2 petitioner that he is innocent, bears no criminal antecedent and has been falsely implicated. He submits that nothing has been recovered from his conscious possession and charge-sheet has already been submitted and there is no allegation of tampering of the prosecution witnesses by the petitioner. . However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Udakishunganj, Madhepura in connection with Chausa P.S. Case No. 379 of 2017. (Nilu Agrawal, J) Devendra/- U T
