====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 09-08-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks regular bail in connection with Special Case No. 167 of 2023 arising out of Danapur P.S. Case No. 788 of 2023 lodged on 11.06.2023 under Sections 376, 511, 506 of the Indian Penal Code and Sections 8 and 12 of POCSO Act.

3. Learned counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 06.12.2023 passed in Criminal Miscellaneous No. 64200 of 2023 with liberty to renew his prayer for bail after framing of charge.

4. Learned counsel for the State opposes the prayer

Patna High Court CR. MISC. No.19301 of 2024(5) dt.09-08-2024 2/2 for bail and submits that the charge has already been framed. The trial Court has reported that the trial is likely to be concluded within nine months.

5. It has been informed to the Court that cognizance has been taken on 12.10.2023, and now one year has crossed.

6. In this view of the matter, this Court is not inclined to grant regular bail to the petitioner.

9. Accordingly, the prayer for regular bail of the petitioner in connection with Special Case No. 167 of 2023 arising out of Danapur P.S. Case No. 788 of 2023, pending before the learned Additional District & Sessions Judge, VII,- cum-Exclusive Special Court (POSCO Act) Patna, is hereby rejected at present.
