JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Jalley P.S. Case No. 211 of 2016 registered under Section 364 of the Indian Penal Code and later on, Section 302 of the Indian Penal Code has been added.

Learned counsel for the petitioner submits that the prayer for bail of the petitioner was earlier rejected vide order dated 08.04.2017 passed in Criminal Misc. No. 9706 of 2017 by this court, on the ground that the name of the petitioner has transpired on the basis of confessional statement of co-accused, Rakesh Kumar Singh, who has already been granted privilege of bail by this Court vide order dated 29.06.2017 passed in Criminal

Patna High Court Cr.Misc. No.23811 of 2017 (4) dt.20-09-2017 Misc. No. 23726 of 2017. Further submission is that petitioner is in custody since 21.10.2016.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M. Ist, Darbhanga, in connection with Jalley P.S. Case No. 211 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
