JUSTICE ARUN KUMAR ORAL ORDER 26-03-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody since 02.11.2017 seeks bail in connection with Parbatta (Bharatkhand) P.S. Case No. 382 of 2017 registered under Sections 25(1-B)a and 26(1) of the Arms Act.

Allegation in brief is that country made pistol along with 13 live cartridges were recovered from the possession of the petitioner.

It is contended that petitioner was apprehended from the house of his brother-in-law and he has falsely been implicated and on the seizure list, there is no independent witness while the same was made in the village and witnesses are two police personnels and the petitioner has no criminal antecedent. Having considered the aforesaid facts and circumstances,

No.17105 of 2018 (2) dt.26-03-2018 2/2 the petitioner, namely, Chintu Yadav, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM 1st Class, Khagaria, in connection with Parbatta (Bharatkhand) P.S. Case No. 382 of 2017.
