1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 409, 419, 420, 465, 471 and 34 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent.

The informant alleges that the named accused persons in connivance forged the signature of Assistant Engineer MNREGA and prepared measurement book and when a direction was issued by the D.M. to institute an FIR, the named accused persons produced a forged letter of Commissioner showing that there was a direction not to

5. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that petitioner retired from service in the year 2015 and is not named in the FIR and his name transpired in the case after one year of the occurrence based on suspicion that he had also accompanied Ram Awatar Mukhiya to the police station where application was submitted along with the letter of the Commissioner.

6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

7. Considering the submissions made by the learned counsel for the petitioner, the petitioner abovenamed, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Harpur P.S. Case No. 06 of 2013 subject to the conditions as laid down under Section 438 (2) of the

8. Learned counsel for the petitioner submits that the defect no. 6(1) shall be removed during the course of the day and rest of the defects are ignored.
