====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-05-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Petitioner seeks regular bail in connection with Kanti P. S. Case No. 549/2024 in a case registered for the offences punishable under Sections 103, 61(2), 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.
3. As per the prosecution case, informant alleges that on 14.10.2024 at about 4:30 PM, while her father was returning home from Kanti, in the meantime, he was shot by 4-5 unknown miscreants near Deohan Siwan. Informant suspects that Jayprakash Singh and others, in conspiracy, committed the alleged offence over a property dispute involving 3 acres of land

4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and his name transpired during course of investigation, on the basis of confessional statement of co-accused Anurag Kumar from whose house, arms and ammunition were recovered. Petitioner is in custody since 20.11.2024. Charge-sheet has already been submitted.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the nature of accusation and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate - 1st , West Muzaffarpur in connection with Kanti P. S. Case No. 549 of 2024.
