The petitioner has challenged the order of cognizance dated 20.10.2013/29.10.2013 passed by the learned Chief Judicial Magistrate, Chapra, Saran in Sonepur P.S. Case No. 490 of 2012 whereby cognizance has been taken under Sections 302/34 of the Indian Penal Code.

No good ground has been raised in the petition for interfering with the order of cognizance.

Patna High Court CR. MISC. No.13563 of 2015(2) dt.08-05-2019 2/2 Needless to state that if the trial of the case has not commenced, the petitioner would be at liberty to avail of the remedies which are available to him under the law.

The petition stands dismissed with the aforesaid observation.
