JUSTICE SUDHIR SINGH ORAL ORDER 28-03-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 302, 376, 341, 323, 325 and 326/34 of the Indian Penal Code and Section 4 of Protection of Children from Sexual Offences Act.

As per prosecution case, Sumitra Kumari, daughter of informant, used to work in the house of one Geeta Devi as a maid servant. Sumitra was engaged as maid in the house of Geeta Devi by petitioner no. 2. Subsequently, Geeta Devi complained regarding unsatisfactory work of Sumitra to the petitioners and asked informant to bring back her daughter. Informant on coming to Patna along with petitioners found her daughter dead with several injuries including on the private part. It is submitted on behalf of the petitioners that they have got no criminal antecedents. There is no allegation of assault against the petitioners. The deceased was in custody of one Geeta Devi. The said Geeta Devi has been granted anticipatory bail vide Cr. Misc. no. 11071 of 2015.

On behalf of the State, it is submitted that petitioners are

Patna High Court Cr.Misc. No.8949 of 2016 (3) dt.28-03-2016 2/2 named in the F.I.R.

Considering the aforesaid facts and circumstances that other co-accused has been granted anticipatory bail, let the above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned 1st Addl. Sessions Judge, Patna, in connection with Special Case no. 4 of 2015 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) sudip/- U T
