The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 149, 323, 504, 506, 427 of the Indian Penal Code and 3(1)(iv)(v)(x) of the SC/ST (Prevention of Atrocities) Act.
The accusations are of dismantling the hutment of the informant's side land which was settled in favour of the informant and abusing by calling caste name.
It is submitted by learned counsel for the petitioners that the accusation is omnibus and general against the petitioners and accusation has been levelled in the background of the fact that
Patna High Court Cr.Misc. No.8532 of 2015 (2) dt.27-02-2015 2 / 2 earlier 144 and 107 Cr.P.C., proceedings were initiated between the informant's side and some of the accused. A statement has been made in paragraph no. 3 of the petition that the petitioners have no criminal antecedent.
Moreover, for initial occurrence of 06.09.2014, F.I.R., was registered on 21.09.2014.
Considering the aforesaid facts, let the petitioners, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Siwan Sadar SC/ST P.S. Case No. 137 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M. Siwan, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
