JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 376 and 354 of the Indian Penal Code and Section 3 (IV) (VI) of the SC/ST (Prevention of Atrocities) Act.
The accusation is of establishing forceful physical relationship with the informant.
It is submitted by learned counsel for the petitioner that for the petty dispute, the accusation has been levelled. The medical opinion does not suggest the commission of the offence and the informant has subsequently retracted from her initial version and filed a petition to that effect before the learned court below.
The aforesaid facts constitute good ground for
Patna High Court Cr.Misc. No.10253 of 2015 (2) dt.13-03-2015 2/2 consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Pirpainty P.S. Case No. 186 of 2014 pending in the court of learned CJM, Bhagalpur. Accordingly, the application is disposed of.
