JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-09-2017 The petitioner seeks regular bail in connection with Jaynagar P.S. Case No. 28 of 2016, registered for offences punishable under Sections 397, 307/34 of the Indian Penal Code and Section 25(1-b)A/26/35/27 of the Arms Act. It has been submitted on behalf of the petitioner that he has not been named in the F.I.R, his name surfaced during the course of investigation, he has been remanded in this case from other case and save and except his own confession, there is nothing against the petitioner. It has also been submitted that there is no allegation of assault against the petitioner and he has not been seen in CCTV footage. Petitioner has been in custody since 22.12.2016.

Learned counsel for the State opposed the prayer for bail.

No.22299 of 2017 (6) dt.21-09-2017 Having heard both sides, considering the fact and circumstances of the case and also the fact that petitioner is an accused in seven other cases, as such, I am not inclined to release the petitioner on bail, at least at this stage, his application for regular bail is, accordingly, rejected.

However, the petitioner may renew his prayer for bail after framing of charge in this case in the court below itself. (Vinod Kumar Sinha, J) sunil/- U T
