The petitioners seek bail in a case instituted for the offence under Section-120(B) of the IPC and Section-30(a) of Bihar Prohibition and Excise Act, 2016.

Prosecution case, in short, is that 165 litres wine is recovered.

It has been submitted on behalf of the petitioners that petitioners are in custody since 31-12-2017 and have got no criminal antecedent. Charge-sheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioners. It is alleged that 165 litres wine is recovered from the car, in question. There is no compliance of Section-100 Cr.P.C.

Patna High Court Cr.Misc. No.14123 of 2018 (2) dt.15-03-2018 On behalf of the State, it is submitted that petitioners are named in the F.I.R./complaint case.

Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 2 nd Additional District & Sessions Judge-cum-Special Judge, Gopalganj in connection with Mohamadpur P.S.
