The petitioner seeks bail in a case instituted for the offence under Section-120(B) of the IPC and Section-30(a) of Bihar Prohibition and Excise Act, 2016.

Prosecution case, in short, is that 15 litres Mahua wine is recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 27-12-2017. Charge-sheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses against the petitioner. It is alleged that 15 litres Mahua wine is recovered from the bag of the petitioner. There is no compliance of Section-100 Cr.P.C.

On behalf of the State, it is submitted that the petitioner is

Patna High Court Cr.Misc. No.14412 of 2018 (2) dt.15-03-2018 named in the F.I.R./complaint case.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 2 nd Additional District & Sessions Judge-cum-Special Judge, Nawadah in connection with Narhat P.S.
