JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2019 The petitioners apprehend their arrest in connection with Ghanshyampur P.S.Case No. 119 of 2018 registered under Sections 304B and 201/34 of the Indian penal Code. Petitioner no. 1 is husband, petitioner no. 2 is brother-inlaw, petitioner no. 3 is father-in-law and petitioner no. 4 is mother-in-law of the deceased and there is allegation against them is of demand of dowry and due to non-fulfillment of the same, setting the deceased on fire and also cremated the dead body.

Having heard both sides and in the facts and circumstances, as stated above, so far petitioner no. 1 is concerned, who is husband, I am not inclined to grant him privilege of anticipatory bail rather he should surrender and make prayer for regular bail which shall be considered on its own merit without being prejudiced by this order. So far petitioner nos. 2, 3 and 4 are concerned, they are , in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, directed to be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Baraul in connection with Ghanshyampur P.S. Case No. 119 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
