The petitioners apprehend their arrest in Katihar Town P.S. Case No. 689 of 2021, registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.

No.12782 of 2022(2) dt.22-08-2022 2/3 As per the prosecution case, all the accused persons named in the FIR having deadly weapons arrived at the house of informant and assaulted him. It is further alleged that petitioner no. 1 assaulted the informant on his head by means of sword. Petitioner nos. 2, 3 and 4 inflicted Dabia blow on his head causing head injury. Md. Raja Sah petitioner no. 6 pressed the neck of informant.
It is submitted that there is case and counter case. Injuries sustained by the injured have been found to be simple in nature. Petitioners claim clean antecedents.
Counsel for informant vehemently opposed the prayer for bail and submitted that petitioners are named in the FIR and there is allegation of assault against petitioners. Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Katihar Town P.S. Case No. 689 of 2021, subject to the conditions as laid down under Section 438(2) of
Patna High Court CR. MISC. No.12782 of 2022(2) dt.22-08-2022 3/3 the Code of Criminal Procedure.
