KUMAR ORAL ORDER 05-06-2020 The proceedings of the Court are being conducted through Video Conferencing and the Advocates joined the proceedings through Video Conferencing from their residence. Heard learned counsel for the petitioner and learned counsel for the State.
Petitioner, who is in custody, seeks bail in a case registered for the offence punishable under Sections 394 of the Indian Penal Code and section 27 of Arms Act. As per fardbeyan recorded by the informant that four unknown miscreants started indiscriminate firing upon the informant, who sustained head injuries and due to which he stopped the Scorpio and then the miscreants took away his Scorpio vehicle.
Patna High Court CR. MISC. No.12221 of 2020(3) dt.05-06-2020 2/2 It has been submitted on behalf of petitioner that petitioner has been implicated in this case only on confession and similarly placed co-accused has been granted bail by a coordinate Bench of this Court as contained in Annexure-2. Petitioner was apprehended by the police soon thereafter with arms and on his disclosure looted scorpio was recovered.
Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected. However, after framing of charge the petitioner would be at liberty to renew his prayer for bail. (S. Kumar, J) veena/rajiv U T
