2. Petitioner apprehends arrest in case registered for the offences punishable under Sections 341, 365, 498(A), 323 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.
3. Prosecution case, in brief, is that daughter of the informant got married with petitioner about three years ago and it is alleged that all the F.I.R. named accused persons including this petitioner committed torture and harassment with her due to non-fulfillment of demand of dowry. On 28.10.21 daughter of the informant went traceless and when informant and her wife inquired about her, they were assaulted by this petitioner and others.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.14249 of 2025(2) dt.28-02-2025 2/2 petitioner is husband of the victim and he never tortured her or demanded any dowry. Allegation of assault is general and omnibus. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail application and submitted that victim in her statement recorded under Section 164 Cr.P.C. has stated that this petitioner along with other accused persons committed torture for dowry and sold her to someone else in Mathura.
6. Considering the nature of accusation and statement of the victim recorded under Section 164 Cr.P.C., prayer for anticipatory bail of the petitioner is refused. (Prabhat Kumar Singh, J) Navya/- U T
