The petitioner seeks bail in Kotwali P.S. Case No. 111 of 2016 registered for the offences punishable under Sections 406, 420, 120(B), 341, 504, 379 and 387 of the Indian Penal Code. The informant made allegation against Md. Asif Pravez that he received Rs. 20 lakhs for a piece of land but, the cost of the said land was Rs. 4,88,000/-. The deed of agreement to sale was executed in favour of minor son of the informant. Md. Asif Pravez assured the informant to give him another land for rest of the amount but, the accused persons did not execute the sale deed. The accused persons snatched money from the possession of the informant.
Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.22359 of 2017 (2) dt.19-05-2017 2/2 petitioner is not named in the FIR and the name of the petitioner figured in the case during course of investigation. Md. Asif Pravez has already been enlarged on anticipatory bail by the learned Sessions Judge, Patna in ABP No. 2179 of 2016 on 05.04.2016 and the case of the petitioner stands on better footing. Considering the facts aforesaid the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 5,000/- (Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in Kotwali P.S. Case No. 111 of 2016.
