2. The petitioner has moved the Court under Section 482 of the Code of Criminal Procedure, 1973 for the following relief:

"That this is an application for quashing the order dated 02-05-2005 passed by the Judicial Magistrate, 1st Class, Patna in Case No. 161(C)/ 04 whereby cognizance for offence under section 406 of the Indian Penal Code has been taken and petitioner was summoned for appearance and to face trial."

3. After some arguments, learned counsel for the petitioner submitted that he may be permitted to withdraw the

Patna High Court CR. MISC. No.7762 of 2015(2) dt.22-04-2019 2/2 application with liberty to file an application before the Court below itself at the appropriate stage.

4. In view of the aforesaid, as prayed for, the application stands disposed off as withdrawn with liberty aforesaid.
