JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-03-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Excise Case No. 150 of 2018 arising out of Parasbigha P.S. Case No. 22 of 2018, registered under Section 30(a) of the Bihar Excise Act, 2016.

The accusation is of recovery of 50 litres country made liquor from the bush near the Khaliyahan of Sohrai Bind, where petitioner was found present.

Learned counsel for the petitioner submits that petitioner had gone to attend the call of nature and at that time he was apprehended mere on suspicion. It is further submitted that petitioner has no criminal antecedent and is in custody since

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II, Jehanabad, in connection with Excise Case No. 150 of 2018 arising out of Parasbigha P.S. Case No. 22 of 2018.
