JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with Special (N.D.P.S.) Case No. 151 of 2019, arising out of NCB/PZU/V Case No. 21 of 2019, registered under Sections 8(c)/20(b)(ii) (c)/29 of the NDPS Act.

The accusation is of recovery of 50 packets each containing 1 Kg Ganja from the Hundai Car, which was being driven by Ajeet Kumar and this petitioner was found sitting in the said car.

Learned counsel for the petitioner submits that petitioner had no knowledge about keeping 50 Kg Ganja in the

Patna High Court CR. MISC. No.13978 of 2020(3) dt.16-06-2020 2/2 Hundai Car and the petitioner was not apprehended at the spot but his name has surfaced later on by Narcotics Control Bureau, Zonal Director, Patna. Further submission is that petitioner is in custody since 25.10.2019.

Having considered the facts and circumstances of the case and huge quantity of seized Ganja from the Hundai Car, from which, petitioner was found sitting, I am not inclined to grant bail to the petitioner. Accordingly, his prayer for grant of bail stands rejected.
