====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-04-2025 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 64, 52, 26(g),41,42 of the Indian Forest Act and sections 27,229 and 31 of the Wild Life Protection Act.
3. As per the prosecution case, a tractor with trolley was seized with illegal sand. Petitioner is owner of the said vehicle.
4. Learned counsel appearing for the petitioner submits that the petitioner is a lady and the vehicle in question was in possession of the driver. Petitioner had purchased the tractor on hire purchase basis for L & T Finance Company. Petitioner was not aware of the nature of consignment being carried at the relevant time. Petitioner has incurred huge loss since tractor has also been confiscated for the wrong committed

5. Learned counsel for the State opposes the prayer for bail.
6. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I, Bagahah, West Champaran/successor court, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
