JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-02-2016 Heard learned counsels for the petitioner and the State. The petitioner being wife of the brother of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 304B,201 and 120B of the Indian Penal Code.

The prosecution case is of killing the sister of the informant after three years of marriage for non fulfillment of dowry demands since the husband of the victim had illicit relationship with the petitioner.

It is submitted by the learned counsel for the petitioner that thrust of accusation is against the husband of the victim and for three years after marriage no complaint whatsoever was made before any authority with regard to the illicit relationship of the petitioner

Considering the thrust of accusation against the husband of the victim, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Purnea in connection with Bhawanipur P.S. Case No.197 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
