The petitioners are apprehending their arrest in a case registered for the offences punishable under Section 366A/34 of the Indian Penal Code.
Accusation is of kidnapping the 14 years old daughter of the informant.
It is submitted by the learned counsel for the petitioners that under Section 164 Cr.P.C. statement the victim got her age recorded 18 years, the Court also assessed her age 17 years but during medical examination of the victim the medical board found her age between 18-19 years. It is further submitted that victim under Section 164 Cr.P.C. statement
Patna High Court Cr.Misc. No.10272 of 2015 (2) dt.12-03-2015 stated that she has performed marriage with Tuna Mandal @ Tuneshwar Mandal. Petitioner no. 2 is maternal uncle of Tuna Mandal @ Tuneshwar Mandal. Petitioner nos. 1, 3 and 4 are covillagers of petitioner no. 2. Considering the statement made under Section 164 Cr.P.C., let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Sanokhar P.S. Case No. 103 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
