This is an application for bail in connection with Sessions Trial No. 816 of 2016, arising out of Phulwari Sharif (Janipur) P.S.Case No. 211 of 2016, registered for the offences punishable under Section 395 of the Indian Penal Code. Petitioner is not named in the FIR and it appears that during course of investigation his name transpires. It has been submitted on behalf of the petitioner that except confessional statement there is nothing against the petitioner and there is no recovery from the possession of the petitioner and no T.I. Parade has been held. So far criminal antecedent is concerned, it has been submitted that petitioner is on bail in all other cases.

Having heard both sides and from perusal of the impugned order it appears that trial has commenced and apart from that petitioner has criminal antecedents, I am not inclined to grant bail to the petitioner at this stage.

However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same within a period of nine months.

Accordingly, this application is dismissed with the above observations.
