JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-03-2019 This is an application for grant of anticipatory bail in connection with Chhatarpur P.S. Case No. 137 of 2018, disclosing offences under Sections 341, 323, 354(B), 379, 504, 506 and 34 of the Indian Penal Code.

Allegation against the petitioner is that he along with other accused persons assaulted the husband of the informant and also trying to outrage the modesty of the informant and there is also against the petitioner is of snatching a golden chain of Rs.5000/-.

Submission of learned counsel for the petitioner is that there is case and counter case between the parties and except snatching of golden chain, nothing specific has been attributed against the petitioner and the allegation of snatching chain is ornamental.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-4th, Supaul, in connection with Chhatarpur P.S. Case No. 137 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
