The petitioner seeks bail in connection with Dulhin Bazar P.S. Case No. 235 of 2016, registered under Sections 363, 364, 302, 201 and 120-B of the Indian Penal Code. The accusation is that on 03.12.2016 Pradumn @ Aditya Raj Kumar, brother-in-law of the informant, moved to attend the Tilak ceremony at village Pario Amarpura, but he did not return. On search no any trace was found. Learned counsel for the petitioner submits that on the basis of written report of informant Vikash Kumar regarding missing of his brother-in-law Dulhin Bazar P.S. Case No. 235 of 2016, registered under Sections 363, 364, 302, 201 and 120-B of
Patna High Court Cr.Misc. No.22385 of 2017 (3) dt.29-06-2017 2/2 the Indian Penal Code. In course of investigation, on the basis of call detail of the mobile set of the husband of the petitioner Antosh Kumar, Sukesh Kumar and Sanjay Kumar apprehended and all disclosed about committing murder of the deceased Pradumn @ Aditya Raj Kumar. It is alleged Sukesh Kumar has illicit relation with the petitioner prior to her marriage and they also disclosed that petitioner also used to talk on mobile about progress of the incidence. Further submission is that while Police has submitted Chargesheet, but no any call detail has been collected by the I.O. The petitioner, who is lady, has no criminal antecedent is in custody since 08.12.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-III, Danapur in connection with Dulhin Bazar P.S. Case No. 235 of 2016. (Rajendra Kumar Mishra, J) manish/- U T
