====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 22-03-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Madhepura Excise P.S. Case No. 53 of 2021 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Learned counsel for the petitioner submits that the petitioner is in custody since 25.12.2021, charge-sheet has been submitted and has antecedent of two cases.

Allegation is of recovery of 390 bottle of WISCOF Cough Syrup from the house of the petitioner. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.13411 of 2022(2) dt.22-03-2022 2/2 house is a joint family property and the petitioner was not aware who had kept the WISCOF Cough Syrup in his house. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody and charge-sheet has been submitted, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IV, Madhepura-cum-Special Judge, Excise Act-II, Madhepura in connection with Excise Act No. 1130 of 2021 arising out of Madhepura Excise P.S.
