The two petitioners herein being sisters-in-law of the victim have prayed for grant of anticipatory bail in a case registered under section 304B and 201/34 of the IPC vide Harsidhi P.S. case no. 306 of 2012.
Within two years of marriage the victim was done to death in an unexpected and suspicious circumstance at the 'sasural'.
Contention of the petitioners is that on investigation the police did not find sufficient material and accordingly they were not sent up. The Court differing with the report has taken the cognizance. Hence the apprehension. It is stated that co-accused Durgawati Devi being the mother-in-law along with another has been granted the privilege of anticipatory bail vide order dated
Patna High Court Cr.Misc. No.22173 of 2015 (2) dt.10-07-2015 2/2 19.11.2013 ( part of Annexure 2 series).
In the facts and circumstances of the case, this Court is inclined to extend the privilege of anticipatory bail to the petitioners. Let the petitioners, named above, in the event of their arrest/surrender before the learned Court below within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class Motihari or successor Court in connection with Harsidhi P.S. case no. 306 of 2012 ( G.R. No. 7416 of 2012) Trial no. 1981 of 2014, subject to the condition as laid down under Section 438
(2) of the Cr.P.C. with following conditions:- (i) One of the bailors in each case shall be the own/close family member of the petitioner.
(ii) As soon as the charges are framed the petitioners shall appear in person before the trial court on the date(s) fixed at the trial. In case of default in such appearance on two consecutive dates, the trial Court shall have liberty to cancel the bail bonds of the petitioners and secure their arrest in accordance with law.
