Petitioners apprehend their arrest in a case registered for the offences punishable under Sections 420/34 and other allied sections of the Indian Penal Code.
Prosecution's case in short is that the petitioners did not complete the work for the payment received by them under
Patna High Court CR. MISC. No.11414 of 2020(2) dt.25-06-2020 2/2 the different Government schemes.
Learned counsel appearing for the petitioners submits that the petitioners have falsely been implicated in this case. They are secretaries and chairmen of different wards respectively. They submit that the present case has been lodged due to mistake of facts and in fact they have already completed the work allotted to them under the scheme. By referring to Annexure 2, it is submitted that other criminal cases have also been lodged for the similar allegation.
Considering the facts of the case, let the petitioners, above named, in the event of surrender before the Court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in Dhibra Police Station Case No. 6/2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
