The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 341 and 307/34 of the Indian Penal Code and Section 27 of the Arms Act pending in the learned court below.

Allegation against the petitioner is that he has fired upon the daughter of the informant and the injury was found in her right thigh.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that there is admitted land dispute between the parties. He submits that investigating officer of this case neither found any cartridges nor blood on the earth at the

Patna High Court CR. MISC. No.15996 of 2023(2) dt.17-05-2023 2/2 place of the occurrence. He further submits that petitioner has got not criminal antecedent as stated in para-3 of the bail application.

Per contra, learned APP for the State vehemently opposing the bail application and submitted that the allegation levelled as the petitioner is serious in nature. Hence, he does not deserve anticipatory bail.

Considering the nature of the offence, I am not inclined to enlarge the petitioner on bail in connection with Barhariya P.S. Case No. 279/2022. Accordingly, his prayer for anticipatory bail is hereby rejected.
