The petitioner seeks bail in a case registered under Sections 413, 414 of the Indian Penal Code.

The prosecution case in short is that stolen motorcycle was recovered from possession of accused persons including the joint house of the petitioner.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 04-12-2018. Charge sheet has already been submitted. The petitioner has been made accused in the present case due to mistake of fact. Patna High Court CR. MISC. No.12239 of 2019(3) dt.18-04-2019 2/2 accused with similar allegation have been granted bail by this court vide orders dated 07-03-2019 & 27-03-2019 passed in Cr. Misc. Nos. 14233 of 2019 & 17345 of 2019.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Gaya in connection with Wazirganj P.S. Case No. 384 of 2018.
