JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-09-2017 Heard learned Counsel for the appellant and learned Additional Public Prosecutor representing the State of Bihar. The appellant had earlier approached this Court, setting aside an order passed by learned 2nd Additional Sessions Judge -cum- Special Court (SC/ST Act), Bhagalpur, for his release on bail, vide Criminal Appeal (SJ) No. 826 of 2016, which stood dismissed by an order, dated 19.11.2016, passed by this Court. The appellant again moved before the learned Court below for grant of regular bail, which has been rejected by order, dated 20.06.2017, passed by learned 2nd Additional Sessions Judge -cum- Special Court (SC/ST Act), Bhagalpur, in S. T. No. 672 of 2016, arising out of Sabour Police Station Case No. 63 of 2016. Aggrieved by the said order, the present appeal has been preferred.

Patna High Court CR. APP (SJ) No.2168 of 2017(4) dt.20-09-2017 2/2 drawn my attention to the orders, dated 03.07.2017 and 10.07.2017, passed in Criminal Appeal (SJ) Nos. 1203 of 2017 and 15 of 2017, respectively, to submit that in case of other coaccused persons, the Court has directed for their release after setting aside the orders passed by the Court below, rejecting their prayer for bail.
Considering the above submission, this appeal is allowed. Let the appellant, Md. Ranu @ Rano @ Rannu, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge -cum- Special Court (SC/ST Act), Bhagalpur, in connection with S.T. No. 672 of 2016, arising out of Sabour Police Station Case No. 63 of 2016. This is subject to the condition that the appellant shall present himself before the Court, as and when required and in the event of failure on his part to appear before the Court below on two consecutive occasions, his bail bond shall be liable to be cancelled.
