Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner seeks bail in connection with Khanpur P.S. Case No. 216 of 2020 for the offence under Sections 364, 120B and 302 of the Indian Penal Code. The petitioner is alleged to have committed murder of the son of the informant in the garb of land dispute.
Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is

In fact, there is land dispute between the parties and on account the same, the petitioner has been made accused in this case. The entire prosecution is totally based on surmises and conjuncture. Neither any independent witness has come forward to support the prosecution nor any cogent material has come during course of investigation against the petitioner. Chargesheet has already been submitted in this case on 20.01.2021 under Sections 364, 302 and 120B of the Indian Penal Code. The petitioner is rotting in judicial custody since17.11.2020. Learned A.P.P. for the State has opposed the prayer for bail of the petitioner.
Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Samastipur in connection with Khanpur P.S. Case No. 216 of 2020.
