JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 13-05-2015 Court is not inclined to interfere with the order of suspension contained in Annexure- 1 for many a reasons. However, since the charge-sheet has now been issued to the petitioner, which is Annexure- A to the rejoinder filed on behalf of the petitioner, the Court directs the District Programme Officer (Establishment), Bhagalpur that he will ensure that an enquiry is held against the petitioner on the charges and completed within a period of three months from the date of production of a copy of this order. Petitioner is cautioned and warned that she will not take any
Patna High Court CWJC No.3204 of 2015 dt.13-05-2015 2/2 unnecessary adjournment and render full cooperation to ensure that the time frame indicated by the Court does not turn out to be an exercise in futility. However, if the petitioner renders cooperation, subject to outcome of the enquiry report, follow up action will be taken. If the enquiry is not completed, petitioner may move the Court again. The Court will consider the issue whether suspension is required to be revoked or not.
A copy of this order is also marked to the Director, Primary Education, Government of Bihar, who will enquire into the matter and fix responsibility upon the person also and take appropriate action as to under what circumstances petitioner, a Panchayat Teacher, was allowed to function or officiate as Incharge of the school in question, especially since such arrangement is contrary to the High Court orders as well as the circular issued by the Director.
A copy of this order will be communicated by the office to the said Director.
