Petitioner apprehends his arrest in connection with Raxaul (Haraiya O.P) P.S. Case No.458/2021 dated 24.11.2021, registered for the offence punishable u/s 414 of the IPC and section 20(b) II (b), 23, 27 and 27(A) N.D.P.S. Act. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application. Permission is granted.

Accordingly, the instant application is dismissed as withdrawn.

However, petitioner is at liberty to surrender before the learned Court below within six weeks from today and seek

Patna High Court CR. MISC. No.12699 of 2023(2) dt.19-05-2023 2/2 regular bail and the learned Court below would pass the order, preferably, on the same day, in accordance with law, without being prejudiced of the withdrawal of this application, considering that no contraband article has been recovered form the conscious physical possession of the petitioner.
