JUSTICE BIRENDRA KUMAR ORAL ORDER 20-06-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offence punishable under Section 304B/34 of the Indian Penal Code.

The petitioner is husband of the victim lady Komal Devi. Komal Devi died within one and half years of marriage in her matrimonial house in unnatural circumstances. There is allegation of torture, however, no allegation of illegal demand of dowry in the F.I.R. The case diary would reveal that some witnesses stated that after marriage there was dispute between husband and wife regarding place of normal abode. For that reason the victim committed suicide.

Patna High Court Cr.Misc. No.21401 of 2017 (3) dt.20-06-2017 2/2 Submission is that other co-accused have already been allowed bail in this case by other coordinate Benches of this Court.

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Katihar/Successor Court, in connection with S.T. No.76 of 2017, arising out of Barari P.S. Case No.322 of 2016 (Samapur O.P.) with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
