The petitioner is accused in connection with Case No. C2/104/18 registered under Section 30(A) of the Bihar Prohibition and Excise Act.

The Excise Department raided the house of the petitioner and on the disclosure of the petitioner, 32 bottles each containing 750 ML, 19 bottles each containing 375 ML and 39 bottles each containing 180 ML, Indian made foreign liquor from the semi construction house of Balmiki Khirhar, situated behind the house of the petitioner.

Learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.17235 of 2018 (2) dt.28-03-2018 petitioner has falsely been implicated in this case mere on suspicion. It is further submitted that petitioner has no criminal antecedent and is in custody since 16.02.2018. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Case No. C2/104/18.
