====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 21-06-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 354(c), 366(a), 511, 506 and 34 of the Indian Penal Code. The informant alleges that his daughter was having an affair with the petitioner and he has some photographs with him of her and thus started blackmailing her that the photographs would be made viral if she does not obey him. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is a student who is pursuing his Engineering degree post from Madhya Pradesh. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted

No.12749 of 2023(3) dt.21-06-2023 2/3 that allegation is of blackmailing and giving threat of making the photographs viral if the victim does not obey the petitioner but then neither the photographs have been made viral nor the FIR discloses that in what manner or what threat the petitioner was giving to the victim based on which she was being blackmailed. It is next submitted that since informant and the petitioner were known to each other and the parents of the petitioner on coming to know about the relationship are not willing that the petitioner should pursue the relationship, as such, the present false case came to be instituted for pressurizing the petitioner to marry the daughter of the informant. The learned counsel next submits that petitioner will not abscond rather will cooperate in the investigation and will appear himself as and when required by the investigating officer.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-
Patna High Court CR. MISC. No.12749 of 2023(3) dt.21-06-2023 3/3 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Nagarnausa P.S. Case No. 90 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
