2. The petitioner apprehends his arrest in a case registered for the offence under Sections 76, 352, 351(2), 3(5) of the Bhartiya Nyaya Sanhita, 2023.

3. Allegation against petitioner is to have illegitimate relationship with wife of complainant and thereafter, on allurement of this petitioner, wife of complainant fled away with him along with her two children, some jewellries & clothes worth Rs. 3,15,000/-.

4. Learned counsel for the petitioner submits that as per complaint case, the alleged occurrence took place on 22.03.2025 and complaint was filed after a delay of 4 months on

Patna High Court CR. MISC. No.12158 of 2026(2) dt.24-02-2026 2/2 24.07.2025 without any plausible explanation of delay. He further submits that as a matter of fact, wife of complainant filed a criminal case against complainant and when complainant got knowledge about the said case, he filed present complaint petition only with a view to save his skin.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the aforesaid facts and circumstances as well as delay in filing the complaint petition, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Munger in connection with Complaint Case No. 725(c) of 2025, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
