The petitioner apprehends his arrest in a case registered for the offence punishable under Section 30(a)/30(d) of the Bihar Prohibition and Excise Act, 2018. 40 litres of country made liquor has been recovered from the Chaur of Thora river.

It is submitted that nothing has been recovered from conscious possession of this petitioner. Recovery has been made from open place which is accessible to general public. Petitioner has been falsely implicated in this case merely on suspicion. Petitioner claims clean antecedents.

Considering the facts aforesaid, the petitioner abovenamed in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production

Patna High Court CR. MISC. No.12808 of 2023(3) dt.04-07-2023 2/2 of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No. 2-cum-Additional District & Sessions Judge, Rohtas at Sasaram in connection with Suryapura P.S. Case No. 195 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
