JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 15-03-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Jaynagar P.S. Case No. 179 of 2021, registered for the offences punishable under Sections 341, 323, 376, 511, 448, 504, 506/34 of the Indian Penal Code.

At the very outset, the learned counsel for the petitioner has submitted that though the earlier anticipatory bail petition of the petitioner was rejected, but the further development is that the case though registered under Section 376 of the Indian Penal Code but was not found true against the petitioner under Section 376 of the I.P.C. and only case under Section 354(A), 354(B) and other bailable Section was found

Patna High Court CR. MISC. No.15285 of 2023(2) dt.15-03-2023 2/2 true in supervision note of DSP. He has submitted further that both the parties have compromised the case.

Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhubani in connection with Jaynagar P.S. Case No. 179 of 2021, subject to condition as laid down under section 438(2) Cr. P.C.
