Petitioner apprehends his arrest in a case instituted under Sections 302, 120(B) of Indian Penal Code and 27 of the Arms Act.

The informant alleged that while his son Baijnath Sah was going towards Sonbarsa Raj for painting work, eight accused persons surrounded and killed him.

Learned counsel for the petitioner submits that there is no specific allegation against the petitioner. The main allegation is against Bindeshwari Sah and Pulendra Sah. The petitioner is said to be a member of the mob. He further submits that he has been falsely implicated in this case as earlier he has filed Salkhua P.S.

Patna High Court Cr.Misc. No.8463 of 2016 (2) dt.11-04-2016 2/2 Case No. 121 of 2015 against the informant.

Having regard to the facts and circumstances of the case, in the event of arrest/surrender, let the petitioner named above, be released on bail on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Saharsa, in connection with Salkhua P.S. Case No. 212 of 2015.
