JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 17-03-2015 The second last paragraph of the impugned order passed by the Deputy Director, Welfare, Magadh Division as contained in Annexure- 3 is a clear indicator as to how one family living together in one ward was showing their places at different wards, is trying to corner the benefit of being selected and appointed as an Aanganbari Sevika.
The Court can only step in provided the above factual position is held to be incorrect. Otherwise, as a matter of public policy, one family cannot be allowed to corner benefit of being appointed as Aanganbari Sevika and also create a kind of monopoly in all adjoining wards which any way neither be in the interest of the
Patna High Court CWJC No.3790 of 2015 dt.17-03-2015 2/2 beneficiaries for whom such a scheme is being continued nor in the interest of proper and effective delivery of the object of the scheme. Since the order passed by the Deputy Director has culled out the factual aspect, which is not being seriously denied or being belied by any kind of independent evidence, the said order is not required to be interfered with.
Writ application is dismissed.
