JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-05-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with Magadh Medical P.S. Case No. 15 of 2020, registered under Section 30 (a) of the Bihar Excise Act, 2016.
The accusation is that in course of checking of the vehicle by the police and other excise officials, red colour Piago vehicle was intercepted. On query, the driver of the Piago vehicle disclosed his name Sonu Quarashi (petitioner). On search, 92 bottles each containing 375 ml, 7 bottles each containing 750 ml, 96 bottles each containing 180 ml and 82 bottles each containing 375 ml Indian made foreign and 100 bottles each containing 300 ml country made liquor were
Patna High Court CR. MISC. No.15558 of 2020(2) dt.14-05-2020 2/2 recovered from the Piago vehicle.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent and is in custody since 19.01.2020.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Spl. Judge, Excise, Gaya, in connection with Magadh Medical P.S. Case No. 15 of 2020. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
