19-04-2016 Heard Sri Binod Kumar, learned counsel for petitioners. The present petition was filed against the order of cognizance dated 26-02-2013, whereby the learned Chief Judicial Magistrate, Khagaria has taken cognizance of offence under Sections 302/34 of the Indian Penal Code.
Learned counsel for petitioners fairly accepts that during the pendency of this petition, the case was committed to the court of sessions and after framing of charge, trial has already commenced. Accordingly, there is no need to pass any favourable order.
The petition stands dismissed.
