The petitioner apprehends his arrest in Nathnagar P.S. Case No. 416 of 2018, registered for the offences punishable under Sections 363/34 of the Indian Penal Code. As per the FIR, this petitioner kidnapped the minor daughter of informant.

It is submitted that petitioner has been falsely implicated in this case. Informant is not eye-witness of the occurrence. The victim girl has been recovered from the compartment of Danapur Intercity Express. There is no material which supports the prosecution case. Petitioner claims clean antecedent.

Counsel for State opposed the prayer for bail and submitted that the victim girl in her statement under Section 164

Patna High Court CR. MISC. No.13058 of 2022(3) dt.22-08-2022 2/2 Cr.P.C has supported the prosecution case. The medical board has assessed the age of victim girl between 16-18 years. Considering the facts aforesaid and gravity of offence, I am not inclined to enlarge the petitioner above-named on anticipatory bail.

Accordingly, the prayer for anticipatory bail is rejected.
