JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-03-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with N.D.P.S. Case No. 06 of 2012 arising out of Bheldi P.S. Case No. 74 of 2012 registered for the offence under Sections-20(ii)(b) and 22 of NDPS Act.
In huge quantity, Ganja was recovered from brick kiln of one, Ganga Dayal Yadav, who happens to be father of coaccused, Binod Rai. Admittedly, co-accused, Binod Rai has already been granted privilege of anticipatory bail by a coordinate bench of this court vide order dated 20-02-2015 passed in Cr. Misc. No. 35255 of 2014.
From perusal of the impugned order, it would

No.11049 of 2015 (2) dt.20-03-2015 2/2 appear that in course of supervision, the Deputy Superintendent of Police as well as the Superintendent of Police, found the accusation untrue in respect of the petitioner but at the direction of the DIG the I.O. found the case true against the petitioner and others.
Considering the aforesaid facts and circumstances as well as submission of the parties, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with N.D.P.S. Case No. 06 of 2012 arising out of Bheldi P.S. Case No. 74 of 2012 to the satisfaction of learned Sessions Judge-cumSpecial Judge of NDPS, Saran at Chapra subject to conditions as laid down u/S 438(2) of the Cr. P.C.
