JUSTICE S. B. PD. SINGH) Date : 25-09-2025 Heard learned counsel for the appellant and learned counsel appearing on behalf of the respondent.
2. The appellant and the respondent are also physically present in the Court.
3. Pursuant to our earlier order dated 07.03.2025, an affidavited joint compromise petition duly signed by the both parties has been filed wherein the parties have entered into mutual understanding and have decided to part ways on the following terms and conditions:-
2/4 "1. That in pursuance of the aforesaid compromise, the Appellant has paid and the respondent has received an amount of 11,00,000/- (Rupees Eleven Lakhs only) in two installments.
2. That further the father of the appellant has filed a petition for withdrawal before the learned court below in Complaint Case No. 1016/12 (complainant in the said case) and the learned Court below vide its order dated 15.04.2025 was pleased to allow the application for withdrawal.
A photocopy of order dated 15.04.2025 is annexed herewith and marked as Annexure-1 to this application.
3. That the respondent has also filed an application on 05.05.2025 in Complaint Case No. 535 (c) 2012 pending in the court of SDJM, Danapur for withdrawal of the said case.
A photocopy of the application is annexed herewith and marked as Annexure-2 to this application.
4. That the parties have
3/4 specifically agreed that after this settlement deed they will have no monetary claims over each other. They have further agreed that they shall not file or cause to be filed any case against the either party henceforth.
5. That the parties also agree that there is no other case pending between them apart from the two cases mentioned herein above and the present appeal pending before this Hon'ble Court.
6. That the parties agree to end their matrimonial relation with a decree of divorce which may be passed by this Hon'ble Court.
4. Both the parties have agreed on the above terms and conditions of the joint compromise petition and no longer interested to pursue the present Miscellaneous Appeal.
5. Accordingly, the judgment and decree dated 19.01.2021 passed by learned Principal Judge, Family Court, Rohtas at Sasaram in Matrimonial Case No. 192 of 2012 is set aside in terms of settlement among the parties in the present case.

6. In that view of the matter, Miscellaneous Appeal No. 279 of 2021 is disposed of in terms of above compromise petition. The compromise petition will form part of the decree in this appeal.
