====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 11-04-2018 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Tankuppa P. S. Case No. 03 of 2018 instituted for the offenses punishable under Section 366 (A)/34 of the Indian Penal Code. The allegation, as per written report of the informant, is that his daughter Gaushiya Shabnam, aged about 14 and 1⁄2 years and studying in class X as well as she is doing the coaching classes. It is alleged that on 31.12.2017 she had gone to her coaching institute but thereafter, she did not return. He has apprehension that her daughter was enticed away by the coaching teachers namely, Rohit Kumar and Raju Kumar but the girl was recovered by the police and her statement was recorded under Section 164 Cr. P. C. before the Magistrate and

Patna High Court Cr.Misc. No.15312 of 2018(3) dt.11-04-2018 2/2 she has denied in which she had admitted that she had gone with Rohit Kumar on her own sweet will. The victim girl was also examined by medical Board in which her age has been assessed between 17 to 18 years. It is further submitted that the petitioner has no criminal antecedent and the petitioner is in custody since 08.01.2018.

Considering the facts and circumstances and the materials on record, let the petitioner, above named be released on bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st, Gaya in connection with Tankuppa P.S.Case No. 03 of 2018.
